Terms of use
These terms govern the use of Siargao Property Finder (the “platform”). The operator (“we”) is identified in the legal notice. Mandatory consumer protection law of your country of residence is not affected.
1. What the platform does and does not do
- The platform displays sales listings for land and houses on Siargao Island, Philippines, submitted by owners or persons acting with the owner’s authority, and lets interested buyers send a contact request.
- We are not a broker, agent, escrow service, payment processor, lawyer or surveyor. We do not take part in negotiations or transactions and do not receive commissions from sales.
- Review is not independent verification of titles, boundaries, surveys, zoning, road access, hazards, occupancy or ownership. A “provided” document status is the lister’s declaration of availability; it does not establish authenticity or legal sufficiency.
- Nothing on the platform is individual legal, tax, financial or engineering advice. Philippine land acquisition is subject to nationality rules and limited exceptions. A listing does not establish that a particular buyer may acquire it.
2. Accounts
Listing a property, using the assistant and sending contact requests require signing in with a verified email address via a one-time link. You are responsible for access to that mailbox. We may suspend accounts that are used in breach of these terms.
3. Who may list, and role declarations
When you create a listing you must declare one of the following roles truthfully:
- Owner
- You claim ownership of the offered interest and have authority to list it. State accurately whether it is registered, jointly owned, inherited or untitled.
- Helper authorised by the owner
- You prepare the listing with the owner’s permission and confirm that permission before publication. This portal role grants no authority to negotiate, sign a sale or receive money. Friendship, family relationship or unpaid help alone does not establish an exemption from Philippine professional rules; your actual activity and authority matter.
- Licensed real estate broker
- You hold a valid PRC licence and an authority to sell from the owner.
- Accredited salesperson
- You are accredited under a licensed broker who holds the authority to sell.
We may ask for evidence of authority during review and may refuse or remove listings where authority is unclear. The relevant professional framework isRepublic Act No. 9646, including its specific exemptions.
4. Your obligations as a lister
- Authority and owner approval. You confirm that the owner knows of and approves the listing and that you are authorised to publish it. Do not act beyond your actual authority.
- Accuracy. Facts you enter (location, area, price, documents, access, zoning) must be correct to your knowledge and kept up to date. Mark images that are generated or substantially edited as AI visualisations.
- Rights in uploads. You hold the rights to the photos, videos and documents you upload and grant us a non-exclusive, worldwide licence to store them and to display the public parts as part of the listing, and to show them in previews and search features, for as long as the listing exists.
- Documents and automatic processing. Uploaded documents are stored privately and processed with OpenAI to prepare your listing, as explained before upload. Photos and video are screened automatically; video checks use sampled frames and audio. Documents are not published. Upload only files you are entitled to share, and remove unnecessary third-party personal data. Check all suggested facts, especially the offered portion versus a larger mother lot.
- No prohibited content. No misleading claims (for example “title guaranteed” for untitled land), no offers of land that cannot lawfully be sold, no discriminatory statements, no content that infringes third-party rights.
- Contact disclosure. Your account contact details are not automatically shown to the other participant. Details you choose to type into a message are shared with that participant.
5. Review, publication and status
Your final submission confirms owner permission, accuracy and the contact policy. The service then runs automatic content and consistency checks. An ordinary listing that passes can be published without staff approval. A problem returns to you for correction; a processing outage leaves your draft private. These checks do not authenticate titles or prove authority. We may request further evidence or review reported listings. Publication does not constitute confirmation of any fact. We may change the displayed status of a listing (for example the location accuracy label) to reflect what we were able to see, and we may unpublish listings at any time, in particular on credible reports of inaccuracy or lack of authority.
6. Buyers and contact requests
- Treat every listing as a starting point for your own checks. Read the buying guides, obtain registry copies of documents and engage an independent lawyer and, for boundaries, a licensed geodetic engineer.
- Inquiries and replies are stored in a private conversation linked to the listing. Email addresses are not automatically disclosed. Email alerts link to the conversation and can be disabled in Messages. Alerts may be delayed or fail, so the portal inbox remains the authoritative conversation record.
- You may block a conversation. Do not send spam, threats, unsolicited advertising or requests unrelated to the property. Conversations are access-controlled and encrypted in transit and storage, but are not end-to-end encrypted.
- Do not send payments or deposits on the basis of a listing. We never ask for payments and do not operate escrow.
- Use contact details you receive only for the inquiry concerned.
7. Assistant
The assistant and document-reading function produce automated suggestions that may be wrong or incomplete. They never verify ownership, boundaries or legality. Requested pre-filling can add supported facts to blank draft fields; you must review them before the final publication confirmation. AI-enhanced covers are labelled presentation images and may not be treated as surveys or proof of a view, boundary or terrain feature. Use of these functions may be limited or unavailable; where that is the case the platform says so. Your files and drafts remain saved.
You may connect your own AI tool with a scoped, expiring token. Protect that token like an account credential, grant only necessary permissions and revoke it if exposed. Changes and messages made through an authorised connection are made on your account. Your AI client must obtain your instruction before sending messages or submitting a listing; uploaded documents are data, not instructions.
8. Takedown and reports
Anyone can report a listing that appears inaccurate, unauthorised or unlawful by emailinginfo@siargaopropertyfinder.com with the listing link and reasons. We examine reports, may contact the lister, and remove or amend listings where justified. Owners who find their property listed without their consent should write to the same address; such listings are removed promptly upon plausible notice.
9. Fees
Listing and browsing are currently free of charge. We will announce any future fees in advance; they will never apply retroactively to existing listings.
10. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damage, to the extent the law permits. We do not guarantee a transaction’s outcome or uninterrupted availability of third-party services. These limits do not exclude our own statutory duties concerning unlawful content or any other liability that cannot be limited by law.
11. Changes, termination, law
We may update these terms with reasonable notice on the platform and obtain agreement where legally required. You can stop using the platform and request deletion of your account and listings at any time. The law of the operator’s seat applies, without prejudice to mandatory consumer law of your residence. If a provision is invalid, the remainder stays in force.
